I previously noted the five WTO disputes where agreed procedures between the parties for using the Multi-Party Interim Appeal Arbitration Arrangement (MPIA) have been circulated (as well as an agreement to use Article 25 arbitration outside the context of the MPIA). There is now a sixth dispute, China - Canola Seed from Canada (DS589), which is the second one involving China. The agreed procedures in the case are here. The panel was established on July 26, 2021, and has not yet been composed, so it would be a while until it is ready to be appealed.
We're not seeing any progress in resolving the Appellate Body crisis, which makes it more likely that the MPIA is used for appeals at some point.
