You may have forgotten it was even going on, but lingering out there, waiting to be dissected and analyzed, is the Article 21.5 dispute in U.S. - Tuna II. This should be a very interesting test of whether an environmental measure that affects imports can be implemented in a non-discriminatory manner. We'll find out soon, as the WTO panel just announced it would circulate its final report to the parties on January 30. (Presumably that means the interim report has already been issued, so those of you in the know about what happened should feel free to leak the result in the comments!).
