In the last post, I said I would report the details of the DSB discussion of the Appellate Body reappointment controversy when they are available. Well, Inside US Trade has them here. They probably don't want me reposting the whole article, but here's a snippet:
The United States received universal criticism at a May 23 meeting of the World Trade Organization's Dispute Settlement Body for blocking the reappointment of Korea's Seung Wha Chang to the Appellate Body, but WTO members generally agreed that the scope of the Appellate Body's authority should be a topic of discussion, Geneva sources said.
Korea at the meeting stated its intention to continue to seek the reappointment of Chang, a move that some Geneva sources said could create an intractable impasse over how the DSB should move forward if the U.S. continues to block his reappointment. Procedures for filling the seat on the Appellate Body must be adopted by consensus of the DSB, and as long as Korea continues to push for Chang's reappointment, WTO members are unlikely to agree on a path forward, sources said.
