A while back, I wondered what would happen to NAFTA Chapter 19 if the TPP comes into effect. I can't imagine they would create a TPP equivalent. But will it get phased out through the TPP, or will that part of the NAFTA be carried over?
More significantly, perhaps, what will happen to NAFTA Chapter 11? Will it get folded into a TPP investment chapter? Now that ISDS has become so controversial, and countries are tweaking it in various ways, a TPP investment chapter is unlikely to match the NAFTA provisions. Will the NAFTA Chapter 11 rules remain as they are, and ignore any modern ISDS updates?
