My recollection is that Antigua participated in the negotiation, but the U.S. and Antigua could not reach agreement. Any other details anyone wants to add?Can anyone provide any information about the outcome of the GATS Article XXI renegotiation initiated by the US. I could not find anything on the WTO website or the USTR website.
Isn't it the case that if Antigua refused to participate in the negotiation, then the US could proceed with deleting this commitment from its schedule and antigua would not have any right to retaliate under Article XXI?
Once the schedule is changed and the obligation ceased to exist then the US would no longer be in breach of the ruling so, Antigua would not be able to obtain any further authorisations to retaliate under DSU Article 22.
