A little while back, I mentioned a proposal to change the balance of power on trade issues between Congress and the President. Now, under a bill proposed by Sen. Olympia Snowe, the courts could play a greater role as well:
The Trade CLAIM Act of 2009, which is cosponsored by Senators Jay Rockefeller (D-WV) and Kent Conrad (D-ND), would help domestic industries battle the negative affects of trade liberalization by giving them a greater say in how U.S. trade rights should be enforced. Specifically, the measure would give the U.S. Court of International Trade the authority to overturn decisions by the U.S. Trade Representative not to take enforcement action against countries violating international trade law.
